Terms of Service

1. General

By accessing or playing neverEND ("the Game"), you agree to these Terms of Service. The Game is operated by Carila ("Operator"). If you do not agree, do not use the Game.

Users under the age of 18 must obtain parental or guardian consent before making any purchases.

2. Game Access

The Game is provided as-is. The Operator reserves the right to modify, suspend, or discontinue the Game at any time. Game content, stage design, and mechanics may change at any time. In the event of service termination, the Operator will provide advance notice.

3. Block Purchases and Subscriptions

• Block purchases grant a licence to display content in a designated grid area for the duration of the active subscription. This is not a transfer of ownership.
• Monthly subscriptions renew automatically every month from the purchase date.
• Annual subscriptions renew automatically every year from the purchase date.
• Cancellation takes effect immediately. Upon cancellation, the grid area is released instantly and may be purchased by another user.
• The same grid position and price cannot be guaranteed after cancellation and re-purchase.
• Price locks apply only while subscriptions remain continuously active. Cancellation forfeits the locked price.
• Refunds are not available after the service has been provided, except where required by applicable law.
• Permanent purchase plans, when available, will be governed by separate terms stated at the time of purchase.
• The Operator reserves the right to remove content that violates these Terms without refund.

4. Coupon Codes

• Coupon codes are valid for single use only.
• Codes may not be transferred, sold, or exchanged for cash.
• Expired or already-used codes cannot be applied.
• The Operator reserves the right to void any coupon code at any time.

5. Logo Images

• Supported formats for initial upload: PNG, JPEG. Format for image changes via My Page: PNG, JPEG.
• Images may be changed or repositioned at any time from My Page.
• Changes may take up to 5 minutes to appear in-game due to caching.
• The following content is strictly prohibited:
  — Content infringing third-party copyrights or trademarks
  — Violent, sexual, discriminatory, or otherwise offensive content
  — Content containing personal information
  — Any content deemed inappropriate by the Operator
• The Operator bears no responsibility for any issues arising from prohibited uploads. All liability for such content rests solely with the user who uploaded it.
• By uploading images, you grant the Operator a non-exclusive, worldwide, royalty-free licence to display that content within the Game.

6. Prohibited Conduct

• Use of cheat tools, bots, or automation software
• Harassment or defamation of other players
• Unauthorised access to or attacks on the system
• Registration of false information
• Registering a display name that impersonates another person, company, or organisation
• Any other conduct deemed inappropriate by the Operator

Violations may result in account suspension or termination without prior notice.

7. Test Play Participation

• Participation in test play is voluntary and unpaid.
• By logging in during the test play period, you consent to your nickname being included in the development credits upon public release.
• Credit inclusion is at the sole discretion of the Operator and is not guaranteed.
• Data collected during test play is used solely for development purposes.

8. Cookies and Tracking

The Game uses cookies and similar technologies to maintain login sessions and analyse usage. By using the Game, you consent to the use of cookies. The Game may use third-party analytics tools. You may disable cookies in your browser settings, but this may affect functionality.

9. Privacy

The Game collects play statistics (deaths, stage reached, play time) and account information via Supabase Auth. This data is used to operate and improve the Game. Payment processing is handled by Stripe — the Operator does not store card details. User data may be processed on servers located outside Japan (United States) via Supabase, Stripe, and Vercel. 10. Intellectual Property

All game code, artwork, music, and design are the property of the Operator. You may not copy, distribute, or reverse-engineer any part of the Game without explicit written permission.

11. Limitation of Liability

The Game is provided without warranty of any kind. The Operator is not liable for any damages arising from use of the Game, including but not limited to data loss, service interruption, failure of third-party services (Stripe, Supabase, Vercel), or any loss of time, opportunity, or productivity resulting from use of or addiction to the Game.

12. Dispute Resolution

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

13. Changes to Terms

The Operator may update these Terms at any time. Continued use of the Game after changes constitutes acceptance of the revised Terms.
